Advantages of Using a Registered Agent Service for NY LLC Publication

New York limited liability companies (LLCs) must publish a Notice of LLC Formation in two newspapers for six weeks in the county of the LLC’s principal address.

This can be costly in some counties and can also impact privacy. We’ll explain the advantages of using a registered agent service for NY LLC publication.

Recommended: ZenBusiness registered agent service is free with LLC formation.

Learn why a registered agent service is good for NY LLC publication requirements.

Use a Registered Agent Service to Save Money on NY Publication Costs

The New York LLC publication requirement can be a financial burden for many small businesses. Every new LLC is required to publish a notice of formation in two different newspapers (one daily and one weekly publication) for six weeks. The newspapers must be located in the county of the LLC's principal address.

Small businesses in more expensive counties, especially New York, Kings, Queens, Bronx, and Suffolk Counties, find that using a registered agent service is the best way to alleviate the burden of the New York publishing requirement.

ZenBusiness is headquartered in Albany County, where publication costs are low.

Use a Registered Agent Service for Privacy

Section 206 of New York LLC law requires that the principal address of the LLC be published so that service of process information is made public.

For some LLC owners, like those that operate their LLC from home, this means their home address will be published in a newspaper. LLCs that plan to have an office in the future but have to use the owner's home address beforehand, will also be required to publish their address.

Using a registered agent service allows LLC owners to publish the registered agent's address instead of their own.

How to Complete the NY Publication Requirement

Limited liability companies in New York are required to publish a Notice of LLC Formation and file the New York Certificate of Publication for Domestic Limited Liability Company with the New York Department of State within 120 days of formation.

If you hire a registered agent, you can add an additional service to have them complete the publication step for you or you can complete the publication step yourself to save more money.

Steps to completing the New York LLC publication requirement yourself include the following:

  1. Form a New York LLC yourself or use a registered agent service
  2. Publish a notice of formation in two newspapers in the same county as the principal place of business of the LLC within 120 days of LLC formation for six consecutive weeks. One newspaper must be daily and one newspaper must be weekly.
  3. After publication, the newspapers will send you an affidavit of publication. File the affidavit of publication with a New York Certificate of Publication for Domestic Limited Liability Company with the Secretary of State. The publication filing fee is $50.
